Why Forsyth County Clients Work with Underwood Scoggins

A flat-fee deed preparation service provides a document. We provide counsel on whether the transfer structure aligns with your broader legal and financial goals. That distinction matters most when a deed transfer intersects with an estate plan, an LLC structure, a family dispute, or a title concern that requires legal judgment, not just a form.

Underwood Scoggins brings real estate, business and corporate law, civil litigation, estate planning, and elder law under one roof. When your transfer connects to any of those areas, you don’t need to coordinate between separate firms. We take a client-centered approach: clear communication, attention to your specific goals, and practical guidance suited to long-term outcomes.

We also know that deed transfers sometimes surface competing interests. Whether that calls for negotiation or assertive advocacy, we assess your situation and act accordingly.

The Powerhouses Behind Your Case Meet Your Real Estate Law Team

Our experienced attorneys bring skill, strategy, and relentless determination to every case.

How Deed Transfers Are Handled in Forsyth County

Our role goes beyond drafting. We review prior recorded deeds and relevant title information, advise on the appropriate deed type for your situation, prepare the deed, and guide you through execution and recording. For clients who prefer it, the entire process can be conducted remotely.

Georgia Execution Requirements

Georgia law requires that a deed be signed by the grantor and attested by two witnesses, one of whom must be an official witness, such as a notary public, who actually witnesses the signing, before it can be submitted to the Forsyth County Clerk of Superior Court for recording. The deed must include a legal description of the property, the names of the grantor and grantee, and words of conveyance. The Clerk records and maintains real property records for the county but cannot assist with deed preparation.

Recording Requirements & Fees

Recording in Forsyth County generally requires a completed PT-61 real estate transfer tax form for most deed filings, along with separate payments for the recording fee, transfer tax, and intangible tax where applicable. Under House Bill 288, effective January 1, 2020, the recording fee is $25 per instrument. We walk clients through what to expect during recording.

When Your Deed Transfer Connects to a Bigger Legal Picture

Many deed transfers don’t exist in isolation. A transfer into a revocable trust is part of an estate plan. A transfer to an LLC is part of an asset protection or investment structure. A conveyance involving land subject to a pending road widening or rezoning intersects with eminent domain or zoning matters. When those connections exist, working with a firm that handles all of those areas under one roof makes a real practical difference.

Underwood Scoggins handles real estate disputes involving title, boundary, and easement matters. If a transfer uncovers a title defect or competing ownership claim, we can address it without sending you elsewhere. Our estate planning and elder law practice applies when a transfer is part of a Medicaid planning strategy, involves property held in trust, or concerns property under guardianship. When a deed transfer involves property subject to active zoning applications or eminent domain proceedings in Forsyth County, we can assess how those factors may affect the transfer before it’s recorded.

That integrated view across real estate, business law, litigation, and estate planning is what distinguishes our approach from single-practice deed preparation services.
