Georgia law requires that a deed be signed by the grantor and attested by two witnesses, one of whom must be an official witness, such as a notary public, who actually witnesses the signing, before it can be submitted to the Forsyth County Clerk of Superior Court for recording. The deed must include a legal description of the property, the names of the grantor and grantee, and words of conveyance. The Clerk records and maintains real property records for the county but cannot assist with deed preparation.

Recording Requirements & Fees

Recording in Forsyth County generally requires a completed PT-61 real estate transfer tax form for most deed filings, along with separate payments for the recording fee, transfer tax, and intangible tax where applicable. LLC & Trust Property Transfers: Key Legal Considerations

Transfers involving LLCs or trusts raise legal questions that go beyond executing a deed. Here are some of the considerations that come up under Georgia law.

LLC Formation Requirement: Transferring property to an LLC requires that the LLC be a validly formed Georgia entity or a foreign LLC registered to do business in Georgia. The deed conveys title to the entity, not the individual members.
